Terms of Service

These general terms apply to use of EkamQR websites and services unless a signed order form, subscription agreement, statement of work or other written agreement says otherwise.

1. Agreement and precedence

By accessing or using EkamQR, an authorized user agrees to these terms. Where a customer has a signed commercial agreement with EkamQR, that agreement takes precedence over conflicting general website terms.

2. Authorized use

EkamQR may be used only for lawful workforce, attendance and related business operations. Users must not attempt unauthorized access, interfere with security controls, reverse engineer protected service components where prohibited by law, or use the service to violate another person's rights.

3. Customer responsibilities

  • Provide accurate organization and employee information.
  • Control administrator access, credentials, roles and permissions.
  • Configure attendance, biometric and location workflows lawfully.
  • Maintain supported networks, endpoints and connected devices where the deployment depends on them.
  • Review payroll, statutory and attendance outputs before relying on them for legal or financial decisions.

4. Service availability and changes

Features can vary by deployment, plan, device compatibility and configuration. EkamQR may improve, replace or retire product capabilities over time. Planned changes that materially affect a contracted service are handled according to the applicable commercial agreement.

5. Fees, subscription and taxes

Pricing, billing frequency, taxes, included support and renewal terms are defined in the applicable quotation, order form or subscription agreement. Failure to pay undisputed amounts may result in restrictions or suspension where permitted by the commercial agreement.

6. Customer data

The customer remains responsible for the accuracy, lawfulness and permitted use of data it provides. EkamQR processes customer data to provide the configured service and according to applicable contractual and legal obligations. Additional data-protection terms may be documented in a DPA.

7. Biometric devices and third-party services

Compatibility and behavior of third-party devices, operating systems, email providers, networks and other external services can affect product functionality. EkamQR does not control third-party hardware or services and cannot guarantee features that depend on unsupported or changed third-party behavior.

8. Warranties and operational review

The service is intended to support business operations, not replace customer review. Attendance, payroll, compliance and statutory outputs should be validated against the customer's policies and applicable law. Any express warranty is limited to what is stated in the applicable commercial agreement.

9. Liability

To the extent permitted by law, liability is governed by the applicable commercial agreement. EkamQR is not responsible for losses caused by unauthorized customer account use, unsupported devices, incorrect customer configuration, inaccurate source data, customer network failures or external services outside EkamQR's control.

10. Suspension and termination

Access may be suspended for security risk, unlawful use, material breach or non-payment where allowed by the applicable agreement. Data export, retention and deletion at the end of service follow the applicable contract and deployment model.
